medintel Ltd ("Company", "we", "us" or "our") grants you permission as a participant ("Participant", "you" or "your") to access and use our Mr Doctor physician recruitment and interview administration services ("Services"). These Terms and Conditions govern your participation in market research activities facilitated through Mr Doctor.

PLEASE READ THESE TERMS CAREFULLY BEFORE PARTICIPATING IN ANY MR DOCTOR RESEARCH.

By participating in Mr Doctor / medintel market research interviews, accessing our platform, clicking ‘I agree’ (or similar) when prompted or engaging with our services, you accept these Terms and Conditions in full. If you do not agree to these Terms or our Privacy Policy, you may not participate in our research activities. We may revise these Terms at any time. Continued participation following any changes means you agree to abide by those changes.

2. Description of Services

Mr Doctor, operated by medintel Ltd, provides recruitment and interview administration services for medical device and pharmaceutical market research. We facilitate connections between healthcare professionals and research sponsors to gather clinical insights and market intelligence.

Neither the Company nor the Services provide medical advice or recommendations of particular drugs, devices or products. All research content is provided for market research purposes only. The content should not be used as a substitute for clinical judgment. Research materials may include information from third parties which we do not independently verify.

Your participation in the Services is at your own risk. The Services are designed for market research purposes and do not constitute professional medical advice, diagnosis, or treatment recommendations.

You may not: (i) use another person's name or credentials with the intent to impersonate that person; (ii) use credentials subject to any rights of another person without appropriate authorisation; or (iii) misrepresent your licences, qualifications, or clinical experience.

You are responsible for maintaining the confidentiality of any login credentials and are solely responsible for all activities conducted under your account. You agree to promptly notify us of any unauthorised use of your account or any other breach of security.

Interview Responses: The Services allow you to provide responses, opinions, and other content during market research interviews ("Interview Content"). By participating, you grant the commissioning research sponsor and Mr Doctor a non-exclusive, royalty-free licence to use, reproduce, and analyse your Interview Content solely for the purposes of market research, analytics, and reporting to the research sponsor. This licence includes the right to create aggregated analyses and derivative insights from your responses.

Anonymisation and Reporting: We will take reasonable steps to ensure that reporting of Interview Content to research sponsors is provided in aggregated and/or de-identified form, and that your name and directly identifying information are not disclosed in connection with your specific responses. We may disclose identifying information only where: (i) you have provided separate explicit consent; (ii) disclosure is required for adverse event reporting (see Part D); or (iii) disclosure is required by law.

Research Materials: All survey instruments, discussion guides, stimuli, and research materials remain the sole property of Mr Doctor or the research sponsor. Such materials are protected under applicable intellectual property law and may only be used for the specific research study in which you are participating. Mr Doctor agrees to:

  • Maintain confidentiality of participant responses (except as required by law or adverse event reporting)

  • Anonymise participant data when reporting to research sponsors (as described in Section 5)

  • Comply with applicable data protection laws

You acknowledge and agree that Mr Doctor may preserve Interview Content and may disclose such content if required to do so by law or in good faith belief that such disclosure is reasonably necessary to: (a) enforce these Terms; (b) respond to claims that any content violates the rights of third parties; or (c) protect the rights, property, or safety of the Company, research sponsors, or the public.

Such processing is conducted in accordance with our Privacy Policy and applicable data protection laws, including the UK GDPR and Data Protection Act 2018. All automated processing is subject to human oversight and quality review.

Recording and transcription: Interviews may be recorded and transcribed (including using third-party service providers) for research analysis, quality assurance, and compliance purposes. Where recording is used, we will notify you at the time and may ask you to provide separate explicit consent where required. If you do not consent to recording where it is required for a particular study, you may be unable to participate in that study.

Sub-processors and international transfers: We may use third-party service providers (sub-processors) to assist with transcription, data hosting, and analysis. Your data may be processed in the United Kingdom, European Economic Area, or the United States. Where data is transferred outside the UK, we ensure appropriate safeguards are in place, including Standard Contractual Clauses or equivalent mechanisms approved under UK data protection law.

9. Indemnification

You agree to indemnify and hold the Company and its officers, directors, employees, agents, and partners harmless from any claim, cause of action, suit, or demand, including reasonable legal fees, based on your breach of the warranties in Section 6 or any other provision of these Terms.

10. Third-Party Links and Services

The Company does not warrant that any portion of the Services will be uninterrupted or error-free, that defects will be corrected, or that the Services are free of viruses or other harmful code. The Company does not warrant or make any representations regarding the use or results of the Services in terms of correctness, accuracy, reliability, or otherwise.

We do not make any representation or warranty about whether the Services are adequate to meet your professional compliance obligations under any healthcare regulations or professional codes of conduct. You are responsible for assessing your professional obligations and determining whether your participation complies.

12. Limitation of Liability

IN NO EVENT SHALL THE COMPANY OR ANY OF ITS AFFILIATES, SUPPLIERS OR PARTNERS BE LIABLE FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE OR INCIDENTAL DAMAGES, LOST PROFITS OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION RESULTING FROM OR ARISING UNDER OR IN CONNECTION WITH THE SERVICES, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for all damages, losses and causes of action shall not exceed the amount of compensation agreed for your specific interview participation or one thousand pounds sterling (£800), whichever is greater.

Part C: Screening Guidelines

25. Purpose of Screening

Mr Doctor conducts rigorous screening to ensure that only qualified healthcare professionals participate in our market research studies. Screening protects the integrity of research findings and ensures clients receive insights from appropriate clinical experts.

27. Accurate Information

You agree to provide accurate, current, and complete information throughout the recruitment, screening, and participation process. This includes but is not limited to information about your:

  • Name and identity

  • Country of practice

  • Medical specialty and role

Mr Doctor employs manual and automated validation methods to detect fraudulent, inconsistent, or suspicious responses. If your responses or participation patterns are flagged through these methods, you may be disqualified from the current study and future studies, and any compensation may be forfeited.

Part D: Adverse Events Disclosure

30. Reporting Requirements

Mr Doctor and our client medical device and pharmaceutical companies are required to report details of adverse events related to their products that are raised during market research interviews with healthcare professionals. This obligation exists under medical device vigilance and pharmacovigilance regulations, including requirements of the MHRA (UK), FDA (US), and equivalent regulatory authorities.

31. What This Means for Participants

Although this is a market research interview and your responses will be treated confidentially, if you raise an adverse event or product complaint relating to a specific patient or group of patients during the interview, we are obligated to report this information to the sponsoring company. This requirement applies even if you have already reported the event directly to the company or relevant regulatory authorities.

Your obligations: If you mention an adverse event, product complaint, or safety concern, you agree that we may follow up with you to obtain the minimum necessary details required for regulatory reporting. You agree to cooperate with such follow-up requests in a timely manner.

32. Confidentiality and Personal Information

If you choose to disclose your personal details in connection with any adverse event or product complaint report, this information will be shared with the commissioning company and relevant regulatory authorities solely for safety reporting purposes. In such situations, you may be contacted specifically regarding that adverse event.

Our commitment: We will share only the information required for pharmacovigilance or medical device vigilance purposes. All other information you provide during the interview will remain strictly confidential in accordance with the confidentiality and anonymisation commitments in Sections 5 and 7.

33. Consent to Report

By participating in Mr Doctor research, you acknowledge that the confidentiality protections normally provided under market research codes of conduct may be waived specifically for any adverse event or product complaint you report. This waiver applies only to the adverse event information and does not affect the confidentiality of your other interview responses.
